1. DEFINITIONS
As used in these Terms and Conditions ("Agreement"), the following definitions apply:
- "BOLD" means BOLD Precious Metals, LLC, including its parents, subsidiaries, officers, directors, employees, contractors, agents, successors, and assigns.
- "Customer" means any individual or entity accessing the Website, creating an account, or transacting with BOLD.
- "Order" means a binding transaction in which Customer submits a purchase order to buy Products from BOLD or a Buy Back Transaction to sell Products to BOLD.
- "Locked Price" means a price confirmed by BOLD to Customer for a Buy Back Transaction. A Locked Price constitutes a binding contract subject to these Terms.
- "Market Loss" means market loss as calculated under BOLD's Market Loss Policy.
- "Unpaid order fee" means the $35.00 fee that applies when an Order to purchase Products from BOLD is not paid for and is cancelled.
- "ACH payout fee" means the $35.00 fee deducted from a Buy Back payout when Customer chooses to be paid by ACH bank transfer. It is a payment-method cost, not a penalty.
- "Late or cancelled lock fee" means the $35.00 fee that applies when Customer locks a price to sell Products to BOLD and then does not upload tracking in time, does not ship, or cancels.
- These three fees are separate charges for different things. The Market Loss Policy explains each of them.
- "Partial Payment" means funds received by BOLD from Customer that are less than the total amount due on an Order.
- "Balance Due" means any amount remaining unpaid on an Order after BOLD applies the funds actually received, together with any applicable processing fee, unpaid order fee, late or cancelled lock fee, or Market Loss.
- "Partial Payment Accommodation" means a discretionary arrangement that BOLD may, but is never required to, offer to a Customer who has made a Partial Payment. Where BOLD elects to offer one, BOLD will contact Customer regarding the shortfall and will then apply one of the two forms described in Section 6: Pay in Full or Partial Pay & Ship. BOLD determines which form applies.
- "Business Day" means any day other than Saturday, Sunday, or federal holidays when banks in Travis County, Texas are open.
- "Delivery" occurs when a carrier marks a package as delivered, or when delivered to any person at Customer's address, or when released under Customer's signature-waiver or delivery instruction.
- "Inspection" means BOLD's process of authenticating, weighing, testing, and evaluating Products sent to BOLD, including destructive testing where reasonably necessary.
- "Non-Conforming Item" means any item inconsistent with Customer's representations, including counterfeit, altered, damaged, short-weight, improperly described, or otherwise unacceptable items.
- "Website" means www.boldpreciousmetals.com and affiliated digital systems.
2. ACCEPTANCE OF TERMS
Customer agrees to be legally bound by this Agreement by creating an account, requesting a quote, placing any Order, or clicking or checking a box by which BOLD presents these Terms.
This Agreement governs all Orders, communications, representations, shipments, inspections, and liabilities between Customer and BOLD. No Customer may transact with BOLD absent acceptance of these Terms.
Browsing the Website without taking any of the steps above does not create a contract between Customer and BOLD. BOLD's collection and use of information about visitors to the Website is governed by our Privacy Policy, not by this Agreement.
3. ELIGIBILITY
Customer represents and warrants that Customer:
- Is at least 18 years old and legally competent;
- Is not prohibited by law from purchasing or selling precious metals;
- Provides accurate and complete information;
- Will comply with all laws applicable to the transaction.
BOLD may refuse any Order or terminate any account at its sole discretion.
4. FORMATION OF CONTRACT
A binding contract forms:
(a) Purchases from BOLD: upon BOLD's issuance of an Order number;
(b) Sales to BOLD (Buy Back): upon BOLD's confirmation of a Locked Price.
Time is of the essence in all transactions.
5. PURCHASE OF PRODUCTS FROM BOLD
What governs your order
Each product is sold according to its specification: the metal, the weight, the fineness, the mint or manufacturer, the year or year-range where one is stated, the condition or grade, and the quantity. That specification is what we agree to supply, and it is what your order is measured against.
Descriptions and images are illustrative. Product descriptions, historical and editorial commentary, and photographs are provided to help you choose. For bullion and for secondary market items, photographs are representative of the type of item and not of the individual item you will receive. Where a listing states a random year, our choice of mint, varied condition, or similar, the specific item is our selection within that specification.
Errors and corrections. We may correct typographical, descriptive, pricing and availability errors at any time, including after an order is placed. Where a pricing error is material and we cannot fulfil at the stated price, we will cancel the affected order and refund you in full rather than ship it; we will not hold you to a corrected higher price. An error in descriptive or editorial text that does not change the specification of the item supplied is not a defect in the item.
5.1 Price Confirmation
Prices shown on this website change with the market. For a purchase, the price is the one BOLD confirms when Customer's Order is placed. Upon issuance of an Order number, the purchase price becomes final and Customer assumes all market risk.
5.2 Payment Deadlines
Customer shall remit payment as follows:
- Bank Wire: initiated within one (1) Business Day.
- Check: postmarked within one (1) Business Day; received within five (5) Business Days.
- All payments: received within ten (10) calendar days.
Failure constitutes default.
Payment of less than the full Order total does not satisfy these deadlines. Where BOLD accepts a partial payment, the handling of the outstanding balance is governed by Section 6 (Payment Terms).
5.3 Customer Default
If Customer fails to perform any obligation:
- BOLD may cancel the Order;
- If the Order is not paid for and is cancelled, Customer owes the unpaid order fee and any Market Loss, as set out in the Market Loss Policy;
- Customer may place new Orders, but every new Order must include payment of the full unpaid balance.
5.4 Pricing Errors; System Errors; Right to Cancel
BOLD uses commercially reasonable efforts to ensure pricing accuracy. Nevertheless, Customer acknowledges pricing, typographical, or system errors may occur.
BOLD reserves the absolute right, in its sole discretion, to refuse, cancel, or terminate any Purchase Order affected by an error regardless of whether:
- An Order number has been issued;
- Customer received a confirmation email;
- Payment has been received; or
- The error is discovered before or after acceptance.
If payment was received, BOLD shall refund the amount paid in full, including any processing fee, and such refund is Customer's exclusive remedy.
Customer expressly agrees that:
- No enforceable contract exists where the price is affected by an obvious or material error;
- Customer waives all claims for expectation damages, lost profits, reliance damages, or specific performance;
- Customer's sole recourse is return of funds actually received by BOLD.
5.5 Selling to BOLD / Buy Back Policy
Which provisions govern. This Section 5.5 and Section 8 both address Buy Back Transactions. Where they differ, this Section 5.5 governs.
a. Quotes Are Indicative Only (Not Contracts)
All quotes are informational and may be modified or withdrawn at any time prior to issuance of a Locked Price. Prices shown on this website change with the market. For a sale to BOLD, a price is agreed only when BOLD confirms it as Locked under paragraph (b), and until then the price may move.
b. Price "Lock" and Formation of Agreement
A binding buy back transaction is formed only when: (i) you and BOLD verbally agree on the price over the telephone or in another method expressly approved by BOLD; and (ii) BOLD confirms to you that the price has been "Locked." Once the price is Locked, you are entering into a binding and legally enforceable agreement to sell the agreed products to BOLD at the Locked price, subject to these Terms and Conditions, including BOLD's Market Loss Policy.
We do not record telephone calls. If that ever changes, we will tell you at the start of the call, before any recording begins.
c. Shipping and Time Requirements
After a price is Locked:
- You must upload a valid tracking number for the shipment within three (3) business days of the Lock.
- Products must be received by BOLD within ten (10) business days of the Lock.
If you do not upload tracking within three (3) business days, the Lock is cancelled, and Market Loss and the late or cancelled lock fee are charged to your account, as set out in the Market Loss Policy.
If the products are not received within ten (10) business days, BOLD may, at its sole discretion, cancel the buy back transaction, treat the order as a cancellation under the Market Loss Policy, and/or require a new quote and price Lock for any future transaction.
d. Risk of Loss and Shipping Responsibility (Seller to BOLD)
Unless BOLD expressly provides you with a prepaid, insured shipping label, you are solely responsible for:
- selecting the carrier and shipping method;
- properly packaging the products;
- insuring the shipment for full replacement value; and
- the risk of loss or damage to the products while in transit to BOLD.
BOLD is not responsible for any loss, theft, or damage that occurs before the products are physically received and checked in at BOLD's facility.
e. Inspection, Authenticity, and Condition; Payment Timing
All products sold to BOLD are subject to receipt, verification, and inspection for quantity, weight, authenticity, and condition consistent with the description provided at the time of the quote and/or price Lock.
- BOLD will not issue payment until the products have been fully checked in and accepted by BOLD.
- If the products are received and accepted as described, BOLD will initiate payment via the payment method agreed upon at the time of the Lock: by ACH, within one to two (1-2) Business Days; by check, within five to seven (5-7) Business Days. A payout may be held for seventy-two (72) hours after any change to your bank details, email address or phone number. If you choose payment by ACH, the ACH payout fee is deducted from your payout, as set out in the Market Loss Policy.
- Title to the products passes to BOLD only upon BOLD's final acceptance and initiation of payment.
f. Items Not as Described; Counterfeit, Altered, or Non-Conforming Items
If, upon inspection, BOLD determines in its sole discretion that any product:
- is not as described;
- is counterfeit, altered, damaged, cleaned, or otherwise materially different from what was represented; or
- is a product BOLD does not purchase,
then BOLD may reject the product entirely or offer to purchase it at a revised price.
- BOLD will notify you of any rejection or revised price.
- If you decline BOLD's revised price, you may provide BOLD with a prepaid, trackable shipping label within ten (10) Business Days for return of the rejected items.
- If you do not provide a prepaid label within that time, BOLD may, at its option, (i) ship the items back to you at your expense using a method of its choosing, or (ii) treat the items as abandoned and dispose of them in accordance with applicable law.
In the case of suspected counterfeit or stolen items, BOLD may be required to retain the products and cooperate with law enforcement and may be unable to return such items.
g. Market Loss
Where you agree to sell metal to us and do not complete the sale, or where you do not pay for an order you have placed, a market loss may arise. Our Market Loss Policy explains how market loss is calculated and what charges apply. The Market Loss Policy forms part of these Terms.
h. Items Received After Cancellation
If a buy back transaction is cancelled under paragraph (c) and the products later arrive at BOLD:
- BOLD will not honor the prior Locked price.
- BOLD will give you a new quote at that day's market price.
- If you do not accept the new quote, you may provide a prepaid return shipping label so that the products can be returned to you. You are fully responsible for the cost of return shipping.
- If you do not respond or provide a prepaid return label within a reasonable time, BOLD may treat the items as abandoned and handle them in accordance with applicable law.
i. Seller's Representations
By requesting a quote, locking a price, or shipping products to BOLD, you represent and warrant that:
- you are the lawful owner of the products, or are duly authorized to sell them;
- the products are free and clear of all liens, security interests, and other encumbrances; and
- your sale of the products to BOLD does not violate any applicable law or regulation.
j. Compliance and Identification Requirements
BOLD reserves the right to require identity verification, tax forms, and any information reasonably necessary to comply with its internal policies, anti-money laundering obligations, and other legal requirements. BOLD may refuse to Lock a price, complete a transaction, or issue payment if you do not provide requested documentation to BOLD's satisfaction.
6. PAYMENT TERMS
- Orders ship only after BOLD receives Good Funds for the full Order total, except where BOLD has approved a Partial Pay & Ship arrangement under the Partial Payments bullet below.
- Checks and ACH payments may be held up to 10 banking days, or 45 days if fraud is suspected.
- Processing fees for credit cards, PayPal, Apple Pay, etc., are non-refundable, except where these Terms or our Return Policy provide otherwise, including under Section 5 (What governs your order) and Section 5.4. A refund issued as store credit is never reduced by any fee.
- Partial Payments (Check and Bank Wire Orders). Where Customer remits a paper check or bank wire for less than the full Order total, BOLD may, at its sole discretion, accept the amount received as a partial payment rather than treating the shortfall as a default. BOLD is never obligated to do so, and doing so on one Order does not obligate BOLD to do so on any other. Where BOLD accepts a partial payment, BOLD will contact Customer regarding the shortfall and will then apply one of the two arrangements below. BOLD determines which arrangement applies.
- Pay in Full. The Order is marked Payment Pending and will not be released for shipment until the outstanding balance is paid in full. A separate invoice is issued for the balance, and Customer will see a Pay Now option on that invoice offering paper check, bank wire, or ACH. Customer shall pay the balance within ten (10) calendar days unless BOLD agrees otherwise in writing.
- Partial Pay & Ship. BOLD releases the Order for shipment notwithstanding the outstanding balance. The balance remains immediately owed and is added to Customer's next Order; shipment does not waive, reduce, or settle it. Customer may also pay it earlier using the Pay Now option. Any subsequent Order must include payment of the full balance. If Customer has not placed a subsequent Order within ninety (90) calendar days, the balance becomes payable on demand.
- Balance payment methods. An outstanding balance is paid by paper check, bank wire, or ACH. No fee applies to a balance paid by any of these methods.
- Overpayments. Where BOLD receives funds exceeding the full Order total, BOLD will issue the excess as store credit to Customer's account. Store credit is activated when the Order to which the overpayment relates ships, and may be applied to any future Order. Customer may instead request a refund of the excess. Refunds are made without charge and, where possible, through the original payment method: card payments are refunded to the card, and wire or ACH payments are refunded by bank payment, by store credit or, in some cases, by wire. Refunds issued by paper check are also made without charge. BOLD will confirm the refund method with Customer before issuing the refund.
- Amounts carried to a subsequent Order. Where Customer places a new Order, the following outstanding amounts are added to that Order's total, and the new Order must include payment of them in full: any balance from a Partial Pay & Ship Order, and any unpaid order fee, late or cancelled lock fee and Market Loss charged on a cancelled Order. A balance on an Order held under Pay in Full is not added to a subsequent Order and remains payable on its own invoice.
- Effect of partial payment. Acceptance of a partial payment does not waive any of BOLD's rights under Section 5 or the Market Loss Policy should the balance remain unpaid. It does not re-open or reset the Order price or price lock. It is not a loan, layaway, installment plan, or extension of credit; BOLD charges no interest or finance charge, and every balance is payable on demand.
- Charging a payment method. If Customer owes BOLD money on an Order, Customer agrees that BOLD may charge it to a payment method Customer has given BOLD or authorized. This includes an unpaid balance, an unpaid order fee, a late or cancelled lock fee, and any Market Loss.
7. CUSTOMER DEFAULT; MARKET LOSS
Customer is in default if Customer:
- Fails to pay timely;
- Fails to pay any outstanding balance in full when due under Section 6;
- Attempts to cancel an Order;
- Violates Buy Back deadlines, including the tracking deadline in Section 5.5(c);
- Provides false information;
- Engages in fraud;
- Violates any term herein.
Upon default, BOLD may assess:
- The unpaid order fee or the late or cancelled lock fee, as applicable;
- Market Loss;
- Collection costs;
- Any other remedy allowed by law.
Where the default is an unpaid balance, Customer may place new Orders, but every new Order must include payment of the full unpaid balance.
Market Loss is compensation for BOLD's actual loss, calculated as set out in the Market Loss Policy, and the unpaid order fee and the late or cancelled lock fee represent the reasonable administrative cost of processing the cancellation. These amounts are compensatory and are not a penalty. The Market Loss Policy sets out how Market Loss and these fees are calculated and charged.
8. SALE OF PRODUCTS TO BOLD (BUY BACK TRANSACTIONS)
8.1 Quotes Are Non-Binding
All quotes are informational and may be modified or withdrawn at any time prior to issuance of a Locked Price.
8.2 Locked Price
A binding contract is formed only upon BOLD's confirmation of a Locked Price.
8.3 Shipping Obligations
Customer shall:
- Upload a valid tracking number for the shipment within three (3) Business Days after a Locked Price is issued;
- Ensure BOLD receives items within ten (10) Business Days.
If tracking is not uploaded in time, the Locked Price is cancelled as set out in Section 5.5(c).
8.4 Pricing Errors; System Errors; Right to Cancel (Buy Back)
If any Buy Back quote or Locked Price is affected by a pricing, typographical, or system error, BOLD may cancel the Buy Back Transaction at any time.
Refunds or returns will follow Section 8.7.
Customer waives all claims arising from such cancellation other than return of any items not subject to law-enforcement retention.
8.5 Risk of Loss
Unless BOLD supplies a prepaid insured label, Customer bears all risks of loss, theft, or damage until BOLD physically receives and signs for the package.
8.6 Inspection and Testing
BOLD's Inspection is dispositive and may include destructive testing if necessary. Customer consents to all testing.
8.7 Non-Conforming or Counterfeit Items
If an item is determined to be Non-Conforming:
- BOLD may reject it or revise its offer;
- Customer must provide a prepaid return label within ten (10) Business Days;
- Failure to provide a label constitutes abandonment;
- Counterfeit items may be retained and, where the law requires, surrendered to law enforcement.
8.8 Late Delivery
If tracking is not uploaded in time, or items arrive after the required delivery deadline, BOLD may:
- Cancel the transaction, as set out in Section 5.5(c);
- Apply the Market Loss Policy, as described in Section 5.5(g);
- Provide a new quote at that day's market price, as set out in Section 5.5(h);
- Return items at Customer's expense.
9. SHIPPING; RISK OF LOSS; INSURANCE
- BOLD insures shipments only until Delivery.
- Customer instructions waiving signatures or authorizing alternative delivery void insurance.
- Customer must inspect each delivery and report any problem within the time set out in our Return Policy.
- Failure to cooperate in an insurance claim voids coverage.
10. RETURNS
We do not accept general returns on orders placed through this website. Where there is a problem with your order, our Return Policy sets out what is covered, what is not, how to report it and within what time. The Return Policy forms part of these Terms.
Returns on orders placed through a third-party marketplace, such as eBay, are governed by the return policy shown on that marketplace listing and not by this section.
11. FRAUD PREVENTION; IDENTITY VERIFICATION; AML
- BOLD may delay, cancel, or recall shipments if fraud is suspected.
- Customer must provide identification or documentation when requested.
- BOLD may, in its discretion, require further authorization from you, such as telephone confirmation of your order and other information. We do not record telephone calls. If that ever changes, we will tell you at the start of the call, before any recording begins. BOLD also reserves the right to cancel, delay, refuse to ship, or recall any order if fraud is suspected. During the order process, certain information is captured, which may be used to locate and identify individuals committing fraud. If an order is suspected to be fraudulent, BOLD may share the relevant order records with the card issuer, bank or payment processor involved, for fraud investigation. BOLD discloses information to law enforcement or other government agencies only in response to a subpoena, court order, warrant or similar legal process; where BOLD believes in good faith that disclosure is necessary to prevent imminent physical harm or financial loss, or to report suspected illegal activity; or where a law requires BOLD to report, including federal anti-money-laundering and tax reporting.
- BOLD may ask for identity and other information needed to meet its legal obligations and may decline any transaction that it cannot complete lawfully.
12. WEBSITE USE; INTELLECTUAL PROPERTY
Customer may not copy, scrape, modify, reverse engineer, or commercially exploit the Website or its content without BOLD's written consent.
13. USER CONTENT; DMCA
Any reviews or content posted by Customer grant BOLD a perpetual, worldwide license. DMCA procedures apply for copyright claims.
14. INVESTMENT RISK; DISCLAIMER OF WARRANTIES
Precious metals markets are speculative and volatile. BOLD does not provide investment, legal, or tax advice.
Except as set out in Section 5 (What governs your order) and in our Return Policy, Products and Website are provided "AS-IS" WITHOUT WARRANTY OF ANY KIND, except for any warranty that cannot be disclaimed under applicable law.
15. LIMITATION OF LIABILITY
Subject to the exceptions below, BOLD's maximum aggregate liability arising out of or relating to any Order shall not exceed the greater of:
- one hundred dollars ($100.00), or
- the amount Customer paid in the transaction at issue.
BOLD shall not be liable for consequential, incidental, punitive, or special damages.
This Section does not limit:
- BOLD's obligation to refund amounts paid under Sections 5.4, 6, or 10;
- BOLD's obligation to refund or replace a Product lost or damaged in transit under Section 9;
- liability for fraud, or for death or personal injury caused by negligence; or
- any liability that cannot be limited or excluded under applicable law.
16. INDEMNIFICATION
Customer shall indemnify and hold BOLD harmless from any claims arising out of Customer's breach, misuse, fraud, or violation of law.
17. ARBITRATION; CLASS ACTION WAIVER; COORDINATED CLAIMS
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO BRING A CLAIM IN COURT AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION. YOU MAY OPT OUT OF ARBITRATION WITHIN THIRTY (30) DAYS — SEE SECTION 17.8.
17.1 Scope. Except as stated in Section 17.2, any dispute, claim, or controversy between Customer and BOLD arising out of or relating to these Terms, any Order, the Website, or any BOLD product, service, or communication shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, or by JAMS if the AAA is unwilling or unable to administer. The Federal Arbitration Act governs this Section.
17.2 Exceptions. Either party may bring a claim in small claims court if it qualifies. Either party may seek injunctive relief in court to protect intellectual property or to prevent unauthorized access to the Website. Whether a claim qualifies for the small-claims exception, and whether an agreement was ever formed between Customer and BOLD, are questions for a court.
17.3 Class action waiver. Customer and BOLD each waive any right to bring or participate in a class, collective, consolidated, or representative proceeding. The arbitrator may award relief only to the individual party seeking it, and only to the extent necessary to provide relief on that party's own claim.
17.4 Fees and location. Each party pays the fees allocated to it under the applicable AAA fee schedule, except that BOLD will pay any portion of Customer's filing fee exceeding what Customer would pay to file the same claim in the court of general jurisdiction in Customer's county of residence. Any in-person hearing will take place in the county where Customer resides unless the parties agree otherwise. Hearings may be held by telephone or videoconference, and claims of $25,000 or less may be decided on the documents.
17.5 Coordinated Claims. If twenty-five (25) or more substantially similar arbitration demands are filed against BOLD by or with the assistance of the same or coordinated counsel within a 30-day period (a "Coordinated Claim"), the demands will be administered in batches of up to one hundred (100) demands, with batches proceeding concurrently to the extent the administrator can appoint arbitrators. Each batch is assigned to a single arbitrator and treated as one case for fee purposes.
17.6 Protections in a Coordinated Claim. The following apply to every Coordinated Claim and may not be waived:
- No determination in any batch binds, or is admissible as precedent against, any claimant who was not a party to that proceeding.
- Demands not yet assigned to a batch are not deemed filed and incur no fees until assigned.
- All limitations periods and filing deadlines for unassigned demands are tolled from the date the Coordinated Claim is triggered until the demand is assigned, settled, withdrawn, or resolved.
- If a demand has not been assigned to a batch within nine (9) months after the Coordinated Claim is triggered, the claimant may elect to proceed in an individual arbitration outside the batching sequence, or to opt out of arbitration and pursue that claim individually in court, and BOLD waives any objection to that election.
17.7 Effect if the class action waiver is unenforceable. If Section 17.3 is found unenforceable as to any claim, then this entire Section 17 is void as to that claim only, and that claim shall proceed in a court of competent jurisdiction. Sections 17.3 and 17.7 are not severable from the remainder of this Section 17. Class, collective, consolidated, and representative arbitration are not available under these Terms in any circumstance.
17.8 How to opt out. Customer may reject this Section 17 by sending written notice within thirty (30) days of first accepting these Terms to: BOLD Precious Metals, LLC, Arbitration Opt-Out, 7301 Ranch Road 620 N, Suite 155-194, Austin, TX 78726, or by email to support@boldpreciousmetals.com with the subject line "Arbitration Opt-Out." The notice must state Customer's name, the email address on Customer's account, and that Customer opts out of arbitration. Opting out does not affect any other provision of these Terms, and BOLD will not retaliate for an opt-out.
18. GOVERNING LAW; VENUE
Texas law governs this Agreement, without regard to its conflict-of-laws rules.
Actions to enforce arbitration awards, and any claim not subject to Section 17, shall be brought exclusively in the state or federal courts located in Travis County, Texas, and the parties consent to the jurisdiction of those courts.
Nothing in this Agreement waives any right or protection afforded to Customer under the law of Customer's state of residence that cannot be waived by agreement.
19. ASSIGNMENT
Customer may not assign this Agreement without BOLD's written consent. BOLD may assign its rights and obligations freely.
20. FORCE MAJEURE
BOLD shall not be liable for delays caused by events beyond its reasonable control.
21. SERVICES OTHER THAN PURCHASE AND SALE
These Terms govern your purchase of products from us and your sale of products to us through this website. They do not govern storage, custody, or individual retirement account services. Those services are provided under their own separate agreement, which you will be asked to accept before the service begins. Nothing on this website is an offer of those services on these Terms.
22. ENTIRE AGREEMENT AND ORDER OF PRECEDENCE
These Terms, together with the policies listed below, which are incorporated into these Terms by reference, form the entire agreement between you and BOLD Precious Metals, LLC in relation to your purchase or sale of products through this website, and replace any earlier understanding on the same subjects.
The policies incorporated by reference are:
- the Return Policy
- the Market Loss Policy
- the Shipping and Insurance Policy
- the Payment Options page
- the Sell to BOLD terms in Sections 5.5 and 8 of these Terms
Where one of those policies addresses a subject in more detail than these Terms, that policy governs as to its subject matter. Where there is an irreconcilable inconsistency between these Terms and a policy, these Terms govern.
Our Privacy Policy, Accessibility Statement and copyright notice describe how we operate and what we disclose to you. They are not incorporated into these Terms and do not impose obligations on you.
We may update these Terms and the policies incorporated by reference. The version in effect when you place an order is the version that applies to that order, and we keep prior versions. To request the version in effect on a particular date, contact us using the details in Section 24.
23. SEVERABILITY
Any invalid provision shall be severed and all remaining provisions remain enforceable, except as provided in Sections 17.3 and 17.7, which are not severable from Section 17.
